We at Stays Brasil Tecnologia e Informática S.A. (“Stays”), registered under National Register of Legal Entities No. 26.210.199/0001-76, take your privacy and the protection of your data seriously. This document explains what information is collected from users of our websites – https://stays.net/en, https://stays.net/blog/en/ and https://academy.stays.net/en/support/home and respective services (“You”) and how these data are used.

This document is an integral and complementary part of the Terms of Use of our website, which contains an overview of our platform.

This Privacy Policy applies when you use our websites, fill out our forms, or hire our services. 

WHAT DO YOU NEED TO KNOW TO UNDERSTAND THIS POLICY?

To simplify the reading of this document, we present some useful definitions for its interpretation:

CRM
Acronym for the English term Customer Relationship Management, which can be translated into Portuguese as Customer Relationship Management.

Personal Data
It is information related to a natural person, and that is capable of identifying the person or making their identification possible.

IP (Internet Protocol)
It is the Internet Protocol, which aims to identify each device connected to the network through a unique numbering.

Treatment
It is every form of use that we can make of your Personal Data, including, but not limited to the following activities: collection, storage, consultation, use, sharing, transmission, classification, reproduction, deletion, and evaluation. 

Holder
It is you, the natural person to whom the Personal Data refers.

WHAT TYPES OF PERSONAL DATA DOES STAYS TREAT?

The types of Personal Data and the way Stays collects them vary according to your interaction with our websites or when you hire our Services.

We list below some situations in which we treat your Personal Data in the context of your relationship with Stays:

Browsing data of website visitors (used IP addresses, clicks, and visit times)

These are information collected indirectly when you access our websites. A cookie is inserted in your browser to identify how many times you returned to our website.
These data are used to enable Stays' marketing campaigns, if it is understood that, by your activity on our website, you have the profile of a potential customer.

Name, phone, email, field in which it operates, and quantity of listings it offers
Data that you choose to provide us through your interactions with our forms, landing pages, emails, when you interact with our materials, content, and when you hire our services.

This information allows our activities to be directed to what you expect to receive from us. Among these actions, we can highlight:

• Use of your email to send material or information requested by you when filling out our form, as well as to send newsletters and also to communicate the launch of new free materials or new Stays services;
• Stays employees may contact you via email or phone to conduct surveys or present products and services;
• Send you messages about support or services, including alerts, notifications and updates;
• Perform targeted advertising according to your tastes, interests, and other collected information;
• Communicate with you about products, services, promotions, news, updates, events, and other matters that may be of interest.

Contract history
Information regarding the interactions already carried out between you and Stays, such as email messages, and phone contacts, aims to make our service better and more efficient.

WHO DOES STAYS SHARE YOUR PERSONAL DATA WITH?

Stays operates in partnership with a number of other organizations to enable its activities. Therefore, when using the platform or adhering to the Terms of Use, you understand that Stays, in its legitimate interest, to promote its activities, or when necessary for the execution of contracts or procedures preliminary to them, shares your personal data with partner service providers and with affiliates, affiliated and other companies that have a capital relationship with Stays. This includes sharing the data provided for the acquisition of our products and services with financial institutions and companies that provide credit card services, commercial analysis, customer service, marketing, and fraud prevention. Such companies may even use the personal data you provide to us to eventually send offers of products and services to you.  

We also have a duty to transmit some information to government authorities, as required by law, when required. Our partners are only authorized to use personal data for the specific purposes for which they were hired, so they will not use your personal data for other purposes than those of the provision of services contractually provided or to comply with any legal obligation.

The servers used by Stays are equipped with mechanisms capable of ensuring the security of the data that are located outside Brazil and are located in places that have their own legislation on data protection, therefore, offering adequate protection to these data.

Our partners, when accessing these data, become responsible for the security, treatment, and adequate sharing of this information, not being able to treat them for other purposes not informed to the holders or in non-compliance with the applicable legislation and with this Privacy Policy.

WHAT ARE YOUR RIGHTS AS A HOLDER OF PERSONAL DATA?

Personal Data are yours and Brazilian law guarantees you a series of rights related to them. We are committed to complying with these rights and, in this section, we will explain what these rights are and how you can exercise them. Check it out below:

Confirmation and Access
You can request from Stays confirmation of the existence of treatment of your Personal Data so that, if positive, you can access them, including by requesting copies of the records we have about you.

Correction
You can request the correction of your Personal Data if they are incomplete, inaccurate, or outdated.

Anonymization, blocking, or deletion
Anonymization: occurs when Personal Data can no longer be related to you and, therefore, are no longer considered Personal Data;

Blocking:
temporary suspension of the possibility of processing your Personal Data;

Deletion:
discarding or deleting your Personal Data.

You can request any of these actions if you understand that the Personal Data provided by you are unnecessary, excessive, or are being treated in non-compliance with the law by Stays.

Portability
You can request that Stays provide your Personal Data in a structured and interoperable format, in the terms of the regulation issued by the National Data Protection Authority, aiming at their transfer to a third party, provided that this transfer does not violate the intellectual property or business secret of Stays.

Information about sharing
You have the right to know which public and private entities Stays shares your Personal Data with. If you have doubts or want more details, you have the right to request this information from us. Depending on the case, we may limit the information provided to you, if the disclosure could violate the intellectual property or business secret of Stays or third parties.

Information about the possibility of not consenting
You have the right to receive clear and complete information about the possibility and the consequences of not providing consent when it is requested by Stays. Your consent, when necessary, must be free and informed. Therefore, whenever we ask for your consent, you will be free to deny it – in these cases, it is possible that some services cannot be provided.

Revocation of consent
If you have consented to any purpose of processing your Personal Data, you can always choose to withdraw your consent. However, this will not affect the legality of any processing carried out before the revocation. If you withdraw your consent, it is possible that we may be unable to provide you with certain services, but we will inform you when this occurs.

Opposition
The law authorizes the processing of Personal Data even without your consent or a contract with us. In these situations, we will only process your Personal Data if we have legitimate reasons to do so. If you understand that your Personal Data are being processed in non-compliance with the applicable legislation, you can present opposition, requesting its interruption.

IMPORTANT NOTICES

For your safety, whenever you submit a request to exercise your rights, Stays may request some information and/or additional documents so that we can prove your identity, seeking to prevent fraud. We do this to ensure the safety and privacy of everyone.

In some cases, Stays may have legitimate reasons to fail to comply with a request to exercise rights. These situations include, for example, cases where the disclosure of specific information could violate intellectual property rights or business secrets of Stays or third parties, as well as cases where deletion requests cannot be met due to Stays' obligation to retain data, whether to comply with legal, regulatory obligations or to enable the defense of Stays or third parties in disputes of any nature.

Additionally, some requests may not be answered immediately; however, Stays is committed to responding to all requests within a reasonable time frame and in accordance with applicable legislation.

HOW LONG ARE PERSONAL DATA STORED?

Personal Data are stored only for the time necessary to fulfill the purposes for which they were collected, unless there is any other reason for their maintenance such as, for example, compliance with any legal, regulatory, contractual obligations, among others permitted by law.

If you use our products and services, download our content, or interact with our platform, your information will be kept as long as you keep an active account or during your relationship with us. 

HOW DOES STAYS PROTECT YOUR PERSONAL DATA?

Our responsibility is to take care of your Personal Data and use them only for the purposes described in this Policy. To ensure your privacy and the protection of your Personal Data, we adopt advanced technological resources to ensure the security of all data processed by Stays. Among the security measures implemented are access controls to systems and data processing environments, encryption techniques, security certification, and seals, and the installation of barriers against unauthorized access to databases (including firewalls), among other information security controls.

We strive to protect the privacy of your Personal Data, but unfortunately, we cannot guarantee total security. Unauthorized entries and uses of third parties with your information, hardware or software failures that are not under Stays' control, and other external factors can compromise the security of your Personal Data. Therefore, your action is fundamental for the maintenance of a safe environment for all. We are always looking to improve our services and the way we operate, and therefore this Privacy Policy may undergo updates to reflect the improvements made. Therefore, we recommend periodic visits to this page so that you are aware of the changes made. If relevant changes are made, we will notify you in advance.
